USE OF WEBSITE
The following are the rules or "Terms" that govern use of the "Diaper Disco" Web site, www.diaperdisco.com ("Site"). By using or visiting the Site, you expressly agree to be bound by these Terms and to follow these Terms and all applicable laws and regulations governing the Site, the Province of Ontario and the Government of Canada.
Diaper Disco reserves the right to change these Terms at any time, effective immediately upon posting on the Site. If you violate these Terms of Use, Diaper Disco may terminate your use of the Site, bar you from future use of the Site, cancel your ticket order, and/or take appropriate legal action against you.
The Site may automatically produce search results that reference or link to third party sites throughout the World Wide Web. The Diaper Disco has no control over third party sites nor do we endorse the content within them.
By using the Site to search for, or link to another site, you agree and understand that you may not make any claim against the Diaper Disco for any damages or losses, whatsoever, resulting from your use of the Site to obtain search results or to link to another site.
The Diaper Disco disclaims any and all liability for the acts, omissions and conduct of any third party users, advertisers and/or sponsors on the Site, in connection with the Diaper Disco event or otherwise related to your use of the Site and/or the Diaper Disco event.
The Diaper Disco is not responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with or referenced on the Site.
The Diaper Disco does not promise that the Site will be error-free, uninterrupted or provide specific results from use of the Site or any content, search or link on it.
The Diaper Disco will not be liable for any damages of any kind arising from the use of this Site, including without limitation, direct, indirect, incidental, punitive and consequential damages.
In the event a product/ticket is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information, the Diaper Disco shall have the right to refuse or cancel any orders placed for what has been listed at the incorrect price.
The Diaper Disco shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and payment has been made from your account. If your account has already been charged for the purchase and your order is canceled, The Diaper Disco shall immediately issue a credit to or refund your account in the amount of the charge.
All website graphical design, text and graphics are property of Diaper Disco or its content suppliers and is protected by Canadian and international copyright laws. Any use of the Diaper Disco logo or contents of the website requires written consent of the Diaper Disco.
The Site’s content and software may be used as a shopping resource. Any other use, including reproduction, modification, distribution, transmission, republication, display, or public performance, is strictly prohibited. All rights reserved.
Any disputes arising out of
this site, including any products or services shall
be settled by arbitration in Toronto, Ontario, Canada, in
accordance with the laws of Ontario, Canada. By using
any of our products and services, you hereby waive your right to
seek remedy or restitution in any other jurisdiction or forum of
law other than Ontario, Canada. You also waive your right to
seek remedy or restitutution by any means other than arbitration
in said jurisdiction of Toronto, Ontario, Canada.
PRIVACY POLICY
The Diaper Disco may collect some personal information from email subscribers. In addition to name, address (postal and email), and telephone number, we may collect demographics and opinions of subscribers or potential subscribers.
The Diaper Disco may also use information about subscribers’ and online users’ interests and preferences as well as feedback we receive from surveys to improve our customer service. The Diaper Disco will make all reasonable efforts to ensure that information is used responsibly and only for its intended purpose.
Demographic information may be compiled and shared in an anonymous aggregate form with advertisers and other third parties but no personal details will be traceable or associated with specific individuals.
The Diaper Disco will obtain your express consent before using or disclosing your personal information for any purposes not identified in this policy.
At any time, the Diaper Disco may disclose personal information:
i) in response to subpoenas, court orders or legal process.
ii) if we find that your actions on our web site violate the Terms of Use or any of our usage guidelines for specific products or services
iii) to a purchaser or new corporate entity in the event of a sale, merger or substantial restructuring of our business
If at any time you wish to stop receiving these messages, simply email leslie@diaperdisco.com with instructions to unsubscribe. Please note that your request may take three to four weeks to implement. We are legally bound to inform you that withdrawing your consent may preclude us from providing you with certain products and services.
This policy takes effect on May 29, 2008. Diaper Disco reserves the right to modify this privacy statement at any time, so please review it frequently. If we make material changes to this policy we will notify you on our homepage and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.
EVENT POLICY
PARENTS/CAREGIVERS ARE RESPONSIBLE FOR THEIR CHILDREN AT ALL TIMES.
No adult will be permitted to the event without being accompanied by a child.
A valid ticket must be produced for admittance to the event. Each person requires a ticket (both adults and children). Only infants who are not yet walking are permitted to enter at no cost.
Ticket pricing and availability are subject to change without notice.
Re-entry to the event is not permitted.
The venue management and/or Diaper Disco and its employees reserve the right to refuse admission to, or eject from, the venue any person for any reason deemed necessary, including those who refuse to be searched by a police officer or security official.
The event is subject to the Rules and Regulations of the venue management, the venue and any licensing authority.
If the venue has a valid liquor licence, adults over the age of 19 are permitted to consume alcohol responsibly.
Diaper Disco is not responsible for any adverse affects from Strobe Lighting or Bubble Machines.
CCTV Surveillance is in operation at the venue.
Diaper Disco may record, film or photograph the event/venue. Your attendance at the event shall constitute your approval for inclusion within the photographing, filming and audio recording and your approval permission for the Diaper Disco to make full use of the photographs, recordings and the footage taken with any recourse to you. This material may used for the Diaper Disco website (www.diaperdisco.com), affiliate website, press or promotional materials. If you do not wish your child to be filmed or photographed please advise a Diaper Disco staff member in writing.
Dangerous or hazardous articles are not permitted within the venue, and any person in possession of such articles may be refused entry or ejected.
BY ORDERING OR PURCHASING A TICKET AND/OR ATTENDING THE EVENT, YOU EXPRESSLY UNDERSTAND AND AGREE THAT The Diaper Disco, the venue, or any of its employees, vendors or agents SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, INJURY, THEFT, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSS, EVEN IF The Diaper Disco HAS BEEN ADVISED OF THE POSSIBILTY OF SUCH DAMAGES.
PURCHASE POLICY
All prices, as displayed are listed in Canadian currency (CDN).
All prices for tickets sold through this Site include applicable local sales, admission, and similar taxes.
The receipt of an electronic or other form of order confirmation does not signify the Diaper Disco’s acceptance of your order, it only reflects our acknowledgment of your request for tickets. The Diaper Disco reserves the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verifications or information before accepting any order.
Admission is only valid for the date that has been booked and is listed on the ticket.
All Sales Are Final.
All tickets are non-transferable and non-refundable.
By making a purchase on the Site, you agree that you are at least 19 years of age.
No money will be refunded or bookings exchanged after purchase, unless the event is cancelled.
Ticket fees will not be refunded to any participant because that person fails to attend or is withdrawn from the event for any reason.
The Diaper Disco is not responsible for any exchange rate losses during the order or refund process (for example, if the transaction takes place in one currency but the ticket buyer's credit card account is in another).
No tickets may be used for commercial or promotional purposes (such as competitions, promotions or hospitality packages) without the written consent of the Diaper Disco. Any ticket re-sold or transferred in such a manner will become void and the holder may be refused admission or ejected from the venue.
Diaper Disco is not responsible for deliveries that take longer than the estimated times. If you have not received your tickets within 48 hours prior to the event you have an obligation to notify the Diaper Disco in writing at tickets@diaperdisco.com
The Diaper Disco is not responsible for lost or stolen tickets, change of venue, date, or time. No customer initiated refunds, cancellations, or exchanges allowed with the exception of a canceled event.
In the event of cancellation, the Diaper Disco’s sole obligation and liability shall be to provide a full refund of the face value of the (any ticket service, shipping, and handling fees will not be refunded). No other claims will be entertained. Tickets must be returned to our offices in order for you to receive a refund.
No refunds will be given if the event is running but the venue has changed from the originally advertised location.
Tickets should be returned via traceable means (e.g. certified mail, FedEx, UPS, etc.), and all requests for refunds must be submitted in writing within 5 business days of the cancelled event. By entering payment information and submitting your order you understand that this will serve as an authorized signature.
If the ticket is used in breach of these terms and conditions it is void (and the Diaper Disco and/or the owner of the event reserve the right to cancel this booking and retain any monies paid there for) and the holder may be refused entry to or ejected from the venue.
You agree to indemnify and hold the Diaper Disco, its subsidiaries, affiliates, officers, agents, venue/facility, participants and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of:
i) your use of this Site (www.diaperdisco.com), including also your use of the Site to provide a link to another site or to upload content or other information to the Site; and/or
ii) such third party’s attendance at an event organized by the Diaper Disco with a ticket purchased by you.
Once you place your order on the Diaper Disco website (www.diaperdisco.com), you (customer) have electronically signed an agreement and have 48 hours to contact us about any mistakes, discrepancies, or questions about the tickets. These discrepancies may include: tickets for the wrong event/date and/or if the tickets are damaged. In such instances like these, every effort possible will be made to rectify the situation. However, if your original order is no longer available, and replacement tickets are no longer an option, the order will be cancelled. In order for the refund to be processed, the tickets must be shipped back to the Diaper Disco to receive a refund. Please note that there are no cancellations, refunds or exchanges on orders with inconsistencies.
In no circumstance whatsoever is the Diaper Disco responsible for any typos or incorrect addresses provided by the customer or for returned orders.
With no exceptions, the customer has an obligation/duty to notify the Diaper Disco prior to the order being shipped if there are any changes to the shipping address.
In most circumstances, the Diaper Disco will retain packages returned by Canada Post for later re-delivery to the customer at our discretion.
The Diaper Disco is not responsible in any circumstance for any delivery problems/delays after the order has been shipped.
All times for delivery are dependent on the availability in your delivery area.
BY USING THIS SITE AND CLICKING THE "BUY TICKETS" BUTTON, YOU ARE STATING THAT YOU AGREE TO BE BOUND BY ALL OF THE TERMS, ACKNOWLEDGE THAT YOU HAVE READ THE TERMS CAREFULLY AND ACKNOWLEDGE AND ACCEPT YOUR RESPONSIBILITIES AND THE EFFECT OF THE TERMS ON YOUR LEGAL RIGHTS AND RESPONSIBILITIES.
